Reinforces judgment rendered in June.
On Thursday, the Supreme Court issued a ruling blocking the moratorium on evictions the president’s administration had attempted to extend as concerns over the Delta variant have continued. The court’s decision was made along ideological lines with three of the court’s justices – Stephen Breyer, Sonia Sotomayor, and Elena Kagan – dissenting from the opinion. The majority decision made it clear that any such halting of evictions cannot be unilaterally put in place by the president.
The ruling stated, “if a federally imposed eviction moratorium is to continue, Congress must specifically authorize it.” Congress had not passed a new moratorium on evictions after the Supreme Court ruled to the same effect in June.
Several lawsuits have been filed in federal courts by groups of realtors and landlords challenging the moratorium under the Fifth and Fourteenth Amendments.
